Lessons Learned From a Lawsuit: Creating Service for People with Mental Illness and Mental Retardation

What happens when a federal court orders a state government to correct major problems in its service delivery provisions to people with disabilities, especially people with the dual diagnosis of mental retardation and psychiatric disorders? This book highlights numerous and varied findings of an eight-year (1993-2001) longitudinal study that attempted to measure the impact of this lawsuit on both the people who were known as Thomas S. class members and the state and local services that were available to them in North Carolina.

The Court Order specified that these class members have the right to "minimally adequate habilitation provided in a proper treatment setting." This modest language masks the dramatic changes that were destined to be made in services as most class members have moved away from psychiatric hospitals to communities, from a facilities-based model to a person-centered model, and from fear of the unknown to satisfaction in doing challenging work well. With the dismissal of the lawsuit in 1998 and the end of court oversight, North Carolina is experiencing the challenge of sustaining change. The voices of consumers as well as policy makers, service providers, and family members are heard throughout this book as it examines the effects of legal intervention on the quality of life of people with disabilities.

The three editors of this book have all heen deeply engaged with the Thomas S. Lawsuit as members of a research team at the University of North Carolina at Charlotte. This team administered the work that is covered in this book.
